    Temporary Foreign Worker Program

    The objective of the Temporary Foreign Worker Program (TFWP) is to assist employer

    Who have demonstrated a need to fill jobs for which there are no qualified Canadians are available.

     

    Employers must obtain an LMIA from ESDC and would pay a fees of $1000 for each position requested as the cost of processing the LMIA application.

    ESDC assesses the application to whether there is need for foreign worker because no Canadian workers are available to fill the position and what impact the foreign worker would have on the Canadian labour market. In case of positive assessment, ESDC will provide a positive LMIA

    Labour Market Impact Assessment

    Labour Market Impact Assessment (LMIA) and a temporary work permit are required to be obtained before a foreign national can begin working for the Canadian employer through the TFWP. A LMIA is a document that serves as proof that there will be a positive or neutral impact to the Canadian labour market if the employer hires the foreign worker.

    Employers in Canada should be aware of the requirements, wages, advertisement efforts, exceptions to the advertising requirements, and how to apply for a Labour Market Impact Assessment.

    Comparing the TFWP and IMP

    Temporary Foreign Worker Program

    • For employers to fill jobs in cases where qualified Canadians are not available
    • LMIA must be obtained
    • Lead department ESDC
    • No reciprocity, based on labour market needs for specific occupations and regions
    • Employer-specific work permits (foreign workers are tied to one employer)
    • Uses wage instead of National Occupational Classification (NOC) to determine applicability

    International Mobility Program

    • To advance Canada’s broad economic, social and cultural national interests
    • Based largely on multilateral / bilateral agreements with other countries (e.g. CUSMA)
    • No labour Market Impact Assessment is required
    • Lead department IRCC
    • Based largely on reciprocity
    • Work permits may be employer – specific or open, depending on the situation or agreement
    • Does not stream by wage offered

    Open Work Permit

    Exemptions to the LMIA requirement include jobs that do not fall under the auspices of the TFWP. Offers of employment made by Canadian employers to foreign workers through the International Mobility Program (IMP) do not require a LMIA to be obtained.

    Post Graduate Work Permit

    PGWP- Foreign Nationals currently in possession of a Valid Study Permit and who are about to graduate from a post-Secondary (DLI) institute may apply for a postgraduate open work permit under Post Graduation Work Permit Program (PGWPP).

    Under PGWPP, an Open work Permit enables the foreign national to seek and accept employment, and to work for any employer for a specified period of time.                            

    Inland Spousal/Common-Law Sponsorship Open Work Permit

    Foreign nationals being sponsored for Canadian permanent residence by their spouse or common-law partner may be eligible to apply for an open work permit. In order to apply for an open work permit, the foreign national must be applying for spousal sponsorship from inside of Canada through the inland spousal sponsorship process. As well, applicants should ensure that they meet the full eligibility criteria required for the program.

    International Experience Canada (IEC) gives youth the opportunity to travel and work in Canada for up to 2 years.
    There are 3 different kinds of work and travel experiences available:
    Working Holiday
    Young Professionals
    International Co-op (Internship)

    Bridging open work permit for permanent residence applicants

    A bridging open work permit (BOWP) lets you keep working while you wait for the results of your permanent residence application.
    You may be eligible if you applied to one of the permanent residence programs

    Who can get a work permit as the spouse or common-law partner of a student?

    Your spouse or common-law partner may be eligible for an open work permit if you:

    Business People

    Business people and business visitors are not the same.

    Business people come to do business under a free trade agreement.

    Business people can enter and work in Canada if they qualify under one of these agreements :

    Business Visitors

    business visitor is someone who comes to Canada to take part in international business activities without being part of the Canadian labour market. Business visitors usually stay in Canada for a few days or a few weeks but are able to stay for up to six months.

    Business visitors do not need a work permit.

    Home Child Care Provider and Home Support Worker

    You may be able to apply for permanent residence through the Home Child Care Provider Pilot or Home Support Worker Pilot if you :
